Prior to joining Beena Rezaee Legal & Migration, Nectaria gained valuable and specialised experience working as an Associate to Senior Members of the Administrative Review Tribunal (ART). This experience provided her with a unique insight into the tribunal’s decision-making processes, the assessment of evidence, the application of migration law and the factors considered in the determination of complex review matters.
Her experience within the ART gives Nectaria a distinct understanding of tribunal proceedings from an institutional and decision-making perspective, which she brings to her work representing and advising clients. She understands the importance of well-prepared submissions, relevant and properly presented evidence, and addressing the key legal and factual issues arising in each matter.
* Immigration & Migration Law — Principal Area of Practice: advice and representation across a broad range of Australian visa and migration matters, including complex applications, visa refusals, cancellations, character and other adverse issues, and matters involving family and skilled migration pathways.
* Administrative Review Tribunal (ART): representation and advocacy in migration review matters, including preparation of submissions, evidence and legal arguments, and representation at tribunal hearings.
* Australian Citizenship: advice and assistance with citizenship applications, eligibility issues and citizenship-related matters.
Nectaria’s previous experience as an Associate to Senior Members of the ART provides her with a particularly strong understanding of tribunal practice and procedure. Having worked closely with Senior Members, she has gained first-hand exposure to the consideration and determination of complex matters and an understanding of the importance of presenting a case clearly, comprehensively and strategically.
She brings this experience to her legal practice with a strong focus on thorough preparation, attention to detail and effective advocacy. Her knowledge of tribunal processes enables her to identify the critical issues in a matter and develop focused strategies tailored to each client’s circumstances.
